Terms and Conditions

Welcome to HW Gates. These Terms and Conditions outline the rules and regulations for purchasing our products and services. By placing an order with us, you agree to be bound by these terms. Please read them carefully to ensure a smooth transaction. If you have any questions, feel free to contact us before proceeding.

1. DEFINITIONS

1.1 "Company" refers to HW Gates.

1.2 "Customer" refers to any individual or entity purchasing goods or services from the Company.

1.3 "Products" refers to the gates and related items supplied by the Company.

1.4 "Installation" refers to the fitting of the Products by third-party contractors.

2. ORDERING AND PAYMENT

2.1 A non-refundable deposit of 50% is required to confirm an order. The remaining balance must be paid before delivery or upon fitting if the company installs.

2.2 Prices are subject to change before confirmation of order but will not change after order acceptance unless affected by significant supplier cost increases. In such cases, the Customer will be notified, and they may cancel the order with a full refund.

2.3 If an order is canceled before production begins, the Customer will receive a refund minus administrative fees. If production has started, only costs not yet incurred by the Company will be refundable.

2.4 Failure to pay the full balance before delivery may result in delays or cancellation.

3. DELIVERY & THIRD PARTY INSTALLATION

3.1 Delivery timescales are estimates only and may be subject to change due to unforeseen circumstances. The Company is not liable for delays beyond its control.

3.2 If installation services are provided by third-party contractors. The Company is not liable for defects arising from incorrect installation. Customers must raise installation concerns directly with the installer.

3.3 Any defects due to materials or manufacturing must be reported to the Company within 14 days of delivery.

Company-Installed Gates

3.4 If installation is carried out by HW Gates rather than a third party, the following terms apply:

A site assessment will be required before installation to confirm suitability and identify any potential issues. Additional costs may apply if unforeseen complications arise.
The Buyer must ensure the site is accessible and prepared for installation. Failure to do so may result in additional charges or rescheduling.
Any delays caused by weather, unforeseen ground conditions, or other external factors may result in adjusted timelines. HW Gates will not be held liable for such delays.
Once installation is complete, the Buyer must inspect the work and report any concerns within 48 hours. Any defects due to workmanship will be rectified in accordance with our warranty terms.
Any modifications or alterations made to the installation by the Buyer or a third party after completion will void any warranty provided by HW Gates.

4. WARRANTY & LIABILITY

4.1 The Company provides a 12month warranty on workmanship and materials, excluding natural wood movement, warping, or discolouration caused by environmental factors.

4.2 The Company is not responsible for damages resulting from improper maintenance, misuse, or third-party modifications.

4.3 Liability for defective products is limited to repair, replacement, or refund at the Company’s discretion. The Company shall not be liable for indirect or consequential losses.

5. RETURNS & CANCELLATION

5.1 Orders may be canceled within 14 days of placement, provided production has not commenced.

5.2 Custom-made products are non-refundable unless faulty.

5.3 If a product is faulty, the Customer must notify the Company within 14 days of receipt to arrange a repair or replacement.

6. FORCE MAJEURE

6.1 The Company is not liable for delays or failures due to events beyond its control, including but not limited to natural disasters, supplier failures, transport disruptions, pandemics, or government actions.

7. GOVERNING LAW & DISPUTES

7.1 These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales.

7.2 Any disputes shall be subject to the exclusive jurisdiction of the English courts.

8. GENERAL PROVISIONS

8.1 If any term of these Terms and Conditions is found invalid, the remainder shall continue in full effect.

8.2 The Company reserves the right to update these Terms and Conditions at any time. Continued use of the Company’s services constitutes agreement to any changes.
